ATTENDANCE POLICY

PURPOSE This document has been prepared to inform new employees of the policies and procedures of Mesa Organic Bakery (AVB) and to establish the company’s expectations. In order to promote the orderly, efficient and safe operation of the company, and provide a pleasant and safe work place for all the employees, AVB has adopted and will enforce this policy. This document supersedes and replaces any and all personnel policies and manuals previously distributed, made available or applicable to employees. The Company may change or terminate any of the published or unpublished personnel policies, practices, or employee benefits, without advance notice. In addition, neither these work rules nor any other communication by any Company representative, written or oral, nor any other conduct of any kind between employees and any Company representative, is intended in any way to create an employment contract, or any other contractual undertaking, binding on either the Company or any employee. EMPLOYEE RESPONSIBILITY It is the responsibility of each employee to read and understand this policy. In case of any questions or concerns at any time about this document, the employee will consult with his immediate supervisor. If the supervisor is unable to address the concern, they will inform HR for further clarification. ATTENDANCE POLICY The orderly and efficient business operation of Mesa Organic Bakery Company (the “Company”) requires that all employees be at their assigned work station, ready and able to work, at their assigned starting time on each and every scheduled work day. Accordingly, it is the purpose of this company policy to define acceptable attendance and set forth the administrative guidelines for dealing with attendance issues, including excessive absences. Absences covered by any legally protected leave, such as the Family and Medical Leave Act or Arizona’s Fair Wages and Healthy Families Act (The PST Act) are not counted or otherwise considered for disciplinary or any other adverse action. PROCEDURE Employees accumulating points will receive the progressive disciplinary action noted below based on the number of points accumulated during any rolling 6-month period. 1 day of Suspension without pay (This does not apply to salaried exempt employees)

Termination of Employment

Attendance policy points will remain active for six (6) months from date of occurrence. For purposes of this policy, “Suspension” is defined as one (1) complete shift. A second attendance related suspension in a rolling 12 month period will subject the employee to termination without additional warning
