4.1 Definitions applicable to random drug testing. Following is a list of definitions applicable to this program: Random selection. A method of selecting employees for drug testing that results in an equal probability that any employee in the Company (including the CEO or GM) will be selected and that prohibits any discretion to waive such selection once made. Randomware. A randomizer that uses current employee information out of Success Factors to randomly generate a list of employees to be randomly drug tested and a list of alternates to replace any employee that cannot be notified of their need to be randomly tested within 24 hours. Bakery HR departments were supplied with randomizing software to ensure a totally random list of primary and alternate employee names is pulled. Instructions for generating the list running a list of random names are here. These procedures also authorize facilities to contract with third party providers to generate their own list of primary and alternate names as long as evidence is maintained and can be produced showing that the list of names was randomly generated. Prohibited conduct. All of the following is considered prohibited (terminable) conduct: • Any confirmed positive test for drugs for which the employee has had an opportunity to discuss with the medical review officer and no subsequent negative test result has been obtained from the same sample. • Any refusal to submit to testing to include failure to provide sufficient urine for testing (absent a medical reason). • Any conduct by the employee which interferes with or obstructs the testing process, including any adulteration of a specimen, any attempt to pass off another person’s specimen as their own, or any unreasonable delay in reporting to the testing site. 5. Random drug testing procedures. 5.1 Employee Testing Goals.
If doing random testing, HR will ensure that a minimum of ten percent of all employees will be selected annually for drug testing using a random selection process. Random drug testing will be conducted periodically and randomly at the HR Business Partner’s discretion. 5.2 Time/Cost/Transportation. a. All random testing conducted under these procedures will occur during or just after the employee’s regular or assigned work hours and will be considered work time. Any employee who is assigned to accompany or transport another employee to the test site will be considered on work time.
