or condition has been completed. Violations of the following work rules will result in the four-step progress disciplinary process. 1. Failure of leadership to model or enforce safety rules. 2. Failure of management to follow company policy that requires sales management to collect and review DVIRs every day, determine if a CMV has a safety defect, and ensure that the truck is repaired. 3. Failure to perform appropriate record collection and review. 4. Absent extenuating circumstances, failure of management to allow hourly employees their full meal and rest breaks. D. DRIVER SAFETY REQUIREMENTS (TERMINABLE AT 1st OFFENSE) These are infractions of such a serious nature that they will normally result in immediate discharge without prior warning. 1. Being involved in a hit and run accident, reckless or careless driving, driving under the influence of alcohol or drugs, or driving with a suspended or terminated license while on duty . 2. Failure to notify Human Resources within 5 days of receipt of a citation/arrest for driving under the influence/driving while intoxicated (DUI/DWI), whether during working time and/or outside of working hours/off duty. 3. Failure to report a CMV accident or incident of vehicle theft, vandalism, or rental car incidents. 4. Failure to cooperate fully and respectfully in any DOT inspection. 5. Operating a CMV with a known safety defect. 6. Driving in excess of DOT hours limitations because of inaccurate or unsubmitted/unrecorded driving time for the Company or another company. 7. Failure to maintain or intentional falsification of daily time records or graph logs.
8. Driving before the out-of-service time period or condition is completed. 9. Having two Chargeable Vehicle Accidents within a 12 month period. A
Chargeable Vehicle Accident is an accident that a) results in damage to a vehicle, equipment or other property; b) causes personal injury, or c) an endangers self or others that could have been prevented if the employee had followed the Company's safety procedures or applicable laws or regulations (including, but not limited to striking a stationary object with a vehicle, driving faster than the speed limit or in violation of other traffic rules).
