NOTE: Any accident involving a fatality, or gross or criminal negligence may be dealt with more harshly – the degree of driver negligence will be a major factor in administering discipline, including termination for a first offense. DRIVER SAFETY REQUIREMENTS (PROGRESSIVE DISCIPLINE) The following rules apply to any employee driving a commercial motor vehicle (CMV), and follow either a two-, three-, or four-step disciplinary process. The Company has a strict driver safety policy and follows all applicable state and federal laws. Your responsibilities as a driver of a CMV are to meet the requirements of our driver safety policy and to notify the Company of any changes to your driving record, and to complete DOT certification requirements. Rules 1a – 1j follow the four-step disciplinary process outlined in the Group B Work Rules. 1. Failure to observe driver safety requirements. This list is not all inclusive: a. Using a handheld personal communications device to either read or send e-mail and/or text messages while driving for work, regardless of whether the employee is operating a personal or Company vehicle. Failure to perform the required three (3) vehicle inspections each day: pre-trip, during the trip and post trip, ensuing and documenting the following are present at each inspection: 3 reflective triangles in good repair; spare fuses needed to operate required parts/accessories; and a charged fire extinguisher that is fastened securely in its bracket. Driver failure to complete the daily written Driver Daily Vehicle Inspection Report (DVIR) Failing to ensure that the company vehicle the employee is operating road- worthy. Before operating the vehicle, the driver must inspect the following:

1) Current registration and insurance; 2) Proper display of license plates; 3) Proper inflation of tires and tread depth; 4) Brake test; 5) Lights and whether they are functioning properly; and 6) Whether the windshield wiper blades are usable.

Failing to wear proper footwear as outlined in the dress code in work rule B20. Engaging in any form of road rage, negative gestures, or public indecency displayed to other drivers or to the public while driving
