FAMILY AND MEDICAL LEAVE ACT (CFRA) D. Job Restoration Upon expiration of the leave, an employee will generally be reinstated to his or her position with equivalent seniority, benefits, pay and other terms and conditions of employment. Absences covered by PSL will not count against employees with respect to any applicable attendance, absenteeism, or tardiness policy or practice, provided the employee abides by any call-in or reporting procedures and provides sufficient notice to the Company where feasible under the circumstances. E. Coordination with Other Leave Policies I f a law, regulation or policy provides for greater accrual or use of sick days, the law, regulation or policy with the greater protection may apply. For questions regarding the interplay between your entitlement to leave under other laws, regulations or company policies and your entitlement to leave under the Act, please contact your Human Resources representative. Eligible employees may be entitled to a leave of absence under the California Family Rights Act (“CFRA”). Below is a summary of rights and obligations under the CFRA. A. Eligible Employees To be eligible for CFRA leave, employees must: • Have been employed with the Company for at least 12 months (52 weeks), and • Have worked at least 1,250 hours during the 12 months preceding leave . B. Basic Leave Entitlement Eligible employees may take up to 12 weeks of unpaid leave in a 12-month period for the following reasons: • Birth of a child, including bonding with a child after birth; • Placement of a child with the employee for adoption or foster care; • Care for a spouse, child (including a child of a domestic partner). parent, domestic partner, grandparent, grandchild, sibling, or parent-in-law with a serious health condition ; • Care for the employee’s own serious health condition ; or • A qualifying exigency related to the covered active duty or call to covered active duty of an employee's spouse, domestic partner, child, or parent in the Armed Forces of the United States A serious health condition means an illness, injury, impairment or physical or mental condition that involves inpatient care in a hospital, hospice, or residential medical care facility, or continuing treatment by a healthcare provider. An eligible employee who is the spouse, son, daughter, parent, or next of kin to a covered servicemember who is recovering from a serious injury or illness sustained in the line of duty while on active duty may request up to 26 weeks’ leave during a single 12-month period to care for the servicemember. C. Notice To the extent possible, employees must provide the Company reasonable advance notice of their need for leave. When the need for leave is not foreseeable, employees must provide as much advance notice as practical. Notice should describe the reason for the requested leave, the anticipated duration, and the anticipated date the leave will begin. The Company respectfully requests 30 days’ advance notice in writing to the Human Resources
